What happened

Counsel David Reyes admitted relying on AI, failing to cite-check, and submitting fake cases in the litigation. The AI conduct was one of several forms of misconduct the court addressed, which also included settlement, candor, and discovery misconduct, so the sanctions were not based on AI use alone.

The rule and the sanction

The court ordered Reyes to pay all defense costs and fees, granted the motion to strike, directed him to send the order to the Illinois Attorney Registration and Disciplinary Commission, and ordered dismissal of the case with prejudice after payment of the costs and fees.

How it could have been avoided

Verify every authority the AI supplies against the original. Do not compound an AI problem with other misconduct, since courts consider the whole course of conduct. Self-report and fix errors before the opposing party does.
