Jessica Fuller v. Hyde School, et al.
The case
Jessica Fuller v. Hyde School, et al., D. Me., No. 2:25-cv-00354-SDN, order filed May 5, 2026. Copy of primary document: `~/workspace/goals/ai-sanctions-case-monitoring/files/sources/D-146-fuller-v-hyde-school.pdf`.
What happened
Attorney Kelly Guagenty, or members of her team, used Claude or ChatGPT to draft an opposition and did not perform a line-by-line citation check, submitting hallucinated or inaccurate authorities.
The rule and the sanction
The attorney's duty of reasonable inquiry and candor. Sanctions: mandatory AI continuing legal education; adoption of firm-wide citation-verification procedures; notice to the client; a compliance certification; an amended opposition; and striking the original opposition.
How it could have been avoided
Run a line-by-line citation check on every AI-assisted draft, and adopt written firm procedures that assign a specific attorney to verify each filing before it goes out.
