Jackie L. Miller v. Regions Bank
Episode 2
The case
Most tracker cases are verification failures. This one is a candor failure stacked on top of one, and the candor failure is the larger offense. When the court asked about the AI use behind four fabricated quotations, the lawyer denied and obscured it, then deleted his ChatGPT account after the court ordered him to produce its history. The cover-up is what converted a Rule 11 problem into a suspension.
What happened
Attorney H. Gregory Harp used ChatGPT to draft a filing in Jackie L. Miller's suit against Regions Bank in the Northern District of Alabama and submitted four fabricated quotations. Questioned by the court, he denied or obscured the AI use. After the court ordered production of his ChatGPT history, he deleted the account.
The rule and the sanction
Rule 11 and the duty of candor. The court imposed a public reprimand, with publication required, and ordered notice to all of Harp's clients, opposing counsel, and presiding judges in every pending case. It disqualified him from the case, suspended him from practice before the Northern District of Alabama for six months, and referred him to the Alabama State Bar and other licensing authorities. There is no dollar figure in this sanction; it is reputational and professional, and it follows him into every courtroom he practices in.
How it could have been avoided
Verify the output before filing, and when the court asks, answer straight. Deleting evidence after a production order is spoliation, and it is always worse than the filing that prompted the question.
