Elizondo v. City of Laredo

S.D. Tex., July 23, 2025

The case

Elizondo v. City of Laredo, United States District Court for the Southern District of Texas, Laredo Division, July 23, 2025, No. 5:25-cv-50, Doc. 28. Copy of primary document: ~/workspace/goals/ai-sanctions-case-monitoring/files/sources/D-74-elizondo-v-city-of-laredo.pdf

What happened

Attorney Edward L. Piña filed a brief whose case citations were produced by his law clerk using generative artificial intelligence tools. Piña acknowledged that he failed to verify the accuracy of the citations and that ultimate responsibility fell on him. He apologized to the court and prohibited the use of generative AI at his firm in response to the incident.

The rule and the sanction

The court sanctioned Piña for the unverified AI-generated citations: a $2,500 monetary sanction payable into the court registry within fourteen days; a minimum of three hours of continuing legal education in ethics or legal technology, including at least one hour on the use of generative AI in the legal context, within ninety days with proof of compliance filed on the docket; and service of the order on plaintiff Karina Elizondo with a certificate of service within fourteen days.

How it could have been avoided

Supervising attorneys must personally verify every citation in filings, including work delegated to clerks. Firms should adopt a written policy requiring human verification of all AI-assisted research before filing.
